Top panel fades window titlebar

I have two panels. One on the bottom, and one on the top.
If I maximize a window, thats ok: it uses only the space between the two panels.
But sometimes the new windows placed under the top panel, so i need to put them into the top layer and then move it somewhere else. Is there a solution for this problem?

(Do you have a bugtracker? If not, why?)

It is probably important to know what window manager you are using.

I use openbox.

I can reproduce this easily. It appears to be on the window manager side. I might see if I can fix it there.
